Welcome to WinTuple.com (“WinTuple”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your use of our website, cloud hosting, SaaS, and managed IT solutions (collectively referred to as the “Services”).

By purchasing, subscribing to, or using our Services, you agree to comply with these Terms. If you do not agree, please do not use our Services.

Services Overview

WinTuple provides professional IT and cloud-based solutions, including:
  • Managed Windows VPS & Cloud Servers
  • SaaS & Application Hosting
  • Business Email Hosting
  • Managed IT & Support Services
  • Custom Web Development (ASP.NET / .NET Core)
  • Each service may have specific configurations or policies described in its individual Service Level Agreement (SLA).

1. Account Registration

To use WinTuple services, you must:
  • Provide accurate and complete contact information
  • Maintain confidentiality of your account credentials
  • Be at least 18 years of age or a legally registered entity
  • You are responsible for all activities under your account.
  • Notify WinTuple immediately if you suspect unauthorized access or a security breach.

2. Acceptable Use Policy (AUP)

You agree not to use WinTuple services for any illegal, abusive, or harmful activity, including but not limited to:
  • Hosting or distributing malware, phishing, or spam
  • Storing or transmitting unlawful or obscene content
  • Infringing on copyrights or intellectual property
  • Launching DDoS attacks or interfering with network operations
  • Unauthorized access or penetration testing without permission
  • Violation of the AUP may result in suspension or termination of your account without refund.

3. Service Availability & Performance

We strive to maintain 99.9% uptime for our managed hosting and cloud services. However, WinTuple cannot be held liable for interruptions caused by:
  • Scheduled maintenance
  • Internet or upstream provider issues
  • Force majeure events (e.g., natural disasters, power failures)
  • Client-side misconfigurations or software conflicts
  • We provide 24/7 monitoring for all managed servers under SLA coverage.

4. Service Availability & Performance

You retain full ownership of the data, files, and content you host with us. WinTuple does not claim ownership of client data. However:
  • You are responsible for maintaining your own data backups (unless under a managed backup plan).
  • WinTuple maintains daily or periodic backups for disaster recovery purposes, but cannot guarantee full data restoration in all cases.
  • We strongly recommend maintaining independent off-site backups.

5. Billing & Payments

5.1 General Terms
  • All prices are listed in USD (or PKR, if applicable).
  • Payments are due in advance for each billing cycle.
  • Non-payment may result in temporary suspension or permanent deletion of services after 10 days of overdue status.
5.2 Renewal & Cancellation
  • Services renew automatically unless cancelled before the renewal date.
  • You may cancel at any time through your Client Portal or by emailing billing@wintuple.com
  • Cancellations take effect at the end of the current billing period.
5.3 Refund PolicyRefunds may be considered only for:
  • Duplicate transactions
  • First-time cancellations within 7 days of service activation (for shared/standard plans only)
  • Custom solutions, VPS, SaaS deployments, or development projects are non-refundable once provisioned or initiated.

6. Support & Managed Services

6.1 Standard Support
  • All clients receive ticket-based support via email or portal.
  • Response times vary based on service type and SLA.
6.2 Managed Support Plans. Clients under managed contracts receive:
  • 24/7 monitoring and proactive maintenance
  • Priority ticket handling
  • Periodic system health reports
6.3 Exclusions. Support does not cover:
  • Third-party software debugging
  • Custom code development (unless under a separate contract)
  • Client-side network or device issues

7. Intellectual Property

  • All website content, documentation, logos, and code created by WinTuple are protected under intellectual property laws.
  • Clients retain IP rights for custom-developed software under specific project agreements.
  • You may not copy, resell, or redistribute WinTuple materials without written permission.

8. Confidentiality

  • Both parties agree to maintain the confidentiality of proprietary or sensitive information shared during the course of business. WinTuple will not disclose client data except:
  • When required by law, or When necessary to provide technical support within authorized scope.

9. Limitation of Liability

WinTuple shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:
  • Data loss
  • Business interruption
  • Loss of profits or goodwill
  • Our total liability for any claim shall not exceed the total amount paid by the client during the last three (3) months of service.

10. Suspension or Termination

We reserve the right to suspend or terminate services:
  • For non-payment or AUP violations
  • If required by legal authority
  • If the client’s actions threaten network integrity or other users
  • Clients remain responsible for unpaid fees up to the termination date.

11. Indemnification

You agree to indemnify and hold harmless WinTuple, its employees, and partners from any claims, damages, or expenses arising from your use of our Services or breach of these Terms.

12. Changes to Terms

WinTuple may update these Terms periodically. Updates will be posted on this page with a revised “Last Updated” date. Continued use of services constitutes acceptance of the updated Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Islamabad, Pakistan.
